BOWLING GREEN, Ky. — The man accused of killing a Kentucky State Police trooper waived extradition Friday morning after being arrested this week on an outstanding Tennessee warrant for an alleged probation violation.

Emonnie Branch, 51, is accused of shooting Trooper Hayden Phillips during a Monday traffic stop before fleeing the scene.

According to court records, the shooting was captured on camera before the suspect drove away.

The extradition hearing lasted less than a minute. The judge asked Branch’s attorney how he intended to respond to the warrant. Branch waived extradition, and the paperwork was handed to a bailiff.

Warren County Jailer Stephen Harmon told Barrenside Branch will remain in Kentucky while facing the recent indictment. The waiver could have allowed Branch to return to Tennessee without going through a contested extradition process.

Branch was scheduled to appear for a preliminary hearing Friday, but the hearing was canceled Thursday after a Warren County grand jury indicted him on three charges: murder of a first responder, possession of a handgun by a convicted felon and tampering with physical evidence.

His decision to waive extradition does not resolve or dismiss the Kentucky charges.
